1. Agreement to Terms
By accessing or registering on our Site, you agree to be bound by these Terms and our Privacy and Return
Policies. If you don’t agree, please don’t use our services.
We do not sell or ship outside of the continental United States.
2. Definitions
– “User” means any visitor or registered account holder.
– “Listings” are items offered in auctions or direct sale. All are sold “AS-IS” and “Used”-no warranties.
3. User Registration
– Users must register with accurate info and valid email.
– You’re responsible for your account, password, and all activity under it.
– We may suspend or terminate accounts for misuse or fraud.
4. Auctions & Sales
– All items are sold as-is, used.
– Descriptions and images are for reference; items may vary.
– We use computer-generated descriptions and are not responsible for inaccuracies or omissions.
– Winning bidders must pay promptly; payment methods accepted are noted in listing.
5. No Returns / No Refunds
– All sales are final: no returns, exchanges, or refunds.
– Auction purchases are binding; removal of items is the full responsibility of the buyer.
-Delivery and pickup options from retail stores:
a. If you choose freight delivery there will be a listed shipping and handling fee.
b. Delivery options: We offer delivery between Fresno City and Clovis City limits. Delivery Fees are posted on each item.
c. Delivery Pickup options: You may choose to pick up your items at our warehouse facility or at the location where our items are being held. You must contact seller in order to make pickup date and time arrangements, or if you are having it delivered to your residence or business.
6. Payment, Fees & Taxes
– Online Auction Only: Buyers to pay hammer price + 13% Buyer’s Premium + applicable taxes.
-Retail store sales tax (local sales tax) is applied to all purchases. (No Buyer’s Premium)
– We accept payment methods disclosed at sale.
– Failure to pay may result in account suspension, legal fees, and resale of items.
7. Liability Limitation
– To the fullest extent allowed by law, we disclaim warranties, and limit liability for damages, losses, or theft.
8. User Conduct
– Users must not misuse our Site (e.g., no hacking, spam, illegal content, impersonation).
– Violators may have accounts terminated without notice.
9. Intellectual Property
– All Site content (design, text, images, trademarks) is our property or licensed.
– No redistribution or use without written permission.
10. Third-party Links
We aren’t responsible for third-party links or content. Use at your own risk.
11. Disputes and Arbitration
All disputes including but not limited to credit card chargebacks and item claims will be resolved through
binding arbitration with an independent arbitrator. The complainee shall bear the full cost of arbitration.
12. Privacy Policy
Your use is also governed by our Privacy Policy. By agreeing to these Terms, you consent to our data
practices.
13. Amendments
We may update policies at any time. We’ll publish a new “Last updated” date on the site. Continued use
means acceptance.
14. Governing Law & Disputes
California law governs. Disputes are resolved in Fresno County courts unless otherwise arbitrated.
